Terms of Use
By downloading or using Hueka, you agree to these Terms. Please read them.
1. The standard Apple EULA applies
Unless we have entered into a separate written agreement with you, your use of Hueka is governed by Apple's Licensed Application End User License Agreement (EULA), which is incorporated into these Terms by reference. Where Apple's EULA and these Terms differ, Apple's EULA controls — these Terms only add Hueka-specific points that are not already covered.
2. Hueka Pro subscriptions
Hueka Pro is an auto-renewing subscription sold through the Apple App Store. Currently offered plans:
- Monthly — billed monthly. New subscribers receive a 3-day free trial. Trial automatically converts to a paid subscription unless cancelled at least 24 hours before the trial ends.
- Yearly — billed once per year. No trial. Saves vs. paying monthly.
Prices are shown in your local currency on the in-app purchase screen at the time of purchase. Apple may adjust local prices to reflect exchange rate or tax changes.
Auto-renewal and cancellation
Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the period ends. You can manage or cancel a subscription at any time:
- On iPhone: Settings → your name → Subscriptions → Hueka Pro.
- Or directly from the App Store app, by tapping your profile picture.
Cancellation takes effect at the end of the current paid period; you keep Pro features until then. We do not control billing, refunds, or proration — those are handled by Apple. Refund requests go through reportaproblem.apple.com.
Price changes
If the subscription price changes, Apple will notify you and ask for consent before the next renewal at the new price. Without consent, the subscription will not renew at the new price.
3. What Hueka does — and what it isn't
Hueka analyzes photos of your face on your device and assigns one of 12 color seasons (Spring / Summer / Autumn / Winter, each in Light / True / Deep variants). It also offers a virtual try-on experience that lets you preview makeup, eye, and hair colors on top of a photo you already provided. The result is an opinion based on color science; it is not:
- A medical, dermatological, or diagnostic service.
- A guarantee that clothing or makeup of a recommended color will look good in any specific real-world situation.
- A replacement for in-person professional color analysis.
Lighting, image quality, makeup, hair colorants, and many other factors influence the result. Treat Hueka's output as guidance, not as a verdict.
About the virtual try-on
The try-on overlays you see — lipstick, blush, iris color, hair color — are color overlays applied to your existing photo on your device. Hueka does not generate AI imagery of you, does not modify your face shape, skin tone, body, or features in any way other than tinting specific color regions you selected, and does not produce a photorealistic result. The overlay is an illustrative preview, not a guaranteed prediction of how a real product will look on you in real lighting. No try-on data is uploaded or stored on any server.
4. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of Hueka, except to the extent expressly permitted by applicable law.
- Use Hueka to analyze photos of other people without their consent.
- Use Hueka to develop a competing service, product, or model — including by scraping or systematically copying outputs.
- Use Hueka in any way that violates applicable law.
5. Intellectual property
Hueka, including its name, logo, design, classifier weights, palette databases, written content (essays, archetypes, wardrobe guidance), and source code, is owned by Şamil Nugay and protected by copyright, trademark, and other laws. Your subscription grants you a personal, non-exclusive, non-transferable right to use the app — it does not transfer ownership of anything.
6. User-generated content
Hueka does not host any user content on our servers (see Privacy Policy). Any photos you take stay on your device. If you choose to share a Hueka result card to social media or messaging apps, that is governed by the receiving service's terms.
7. Disclaimers
Hueka is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any defect will be corrected.
8. Limitation of liability
To the maximum extent permitted by law, Şamil Nugay and Hueka will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, goodwill, data, or other intangible losses, arising out of your use of (or inability to use) the app. Our aggregate liability for any claim arising from the app is limited to the amount you have paid for Hueka in the 12 months preceding the claim, or USD $20, whichever is greater.
9. Changes to these Terms
We may update these Terms. If a change is material, we will update the Effective date at the top and, where appropriate, notify users in-app or at the next app update. Continued use of Hueka after a change means you accept the updated Terms.
10. Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws principles. Where Apple's EULA assigns disputes to a different forum, that assignment controls. Nothing in these Terms limits any non-waivable consumer rights you may have under your local law.
